Refund Policy

1) Scope

This policy covers refunds for (a) professional services (fixed-price, time & materials, retainers), (b) software subscriptions/add-ons, and (c) digital deliverables (e.g., code, designs, documentation) provided by us. Where a Statement of Work (“SOW”) or order form sets a different refund arrangement, that SOW/order governs.

2) Eligibility for Refunds

  • Refunds are considered when there is a verified billing error, duplicate charge, or a material failure to deliver the agreed scope attributable to us.
  • You must notify us promptly with evidence and allow us a reasonable opportunity to investigate and cure.
  • Where eligible, refunds may be full, partial, or pro-rata depending on work completed, benefits already received, and third-party costs incurred.

3) Non-Refundable Items

  • Up-front discovery/consultation fees and kick-off deposits once work has started.
  • Approved milestones/deliverables already accepted in writing or by use.
  • Change requests/scope increases executed upon your approval.
  • Third-party fees, cloud usage, licenses, or pass-through costs (see Section 7).
  • “Change-of-mind” or preference changes after acceptance/use.

4) Project Services (Fixed / T&M / Retainers)

  • Fixed-price: If you cancel after acceptance of the proposal/SOW but before delivery, we may deduct (i) hours already worked, (ii) non-recoverable third-party costs, and (iii) a reasonable administrative fee from any refundable balance.
  • Time & Materials: Billed hours and incurred pass-through costs are non-refundable. Prepaid blocks may be refundable pro-rata for unused hours if no work has commenced for that block.
  • Retainers: Monthly retainers reserve capacity and are generally non-refundable once the period starts. If we fail to make capacity reasonably available in that cycle, we may offer a pro-rata credit or partial refund.

5) Subscriptions & Renewals

  • Subscriptions (including add-ons) renew per the plan selected. You can cancel future renewals at any time; access continues until the end of the paid term.
  • Unless required by law or expressly stated otherwise, subscription fees are non-refundable once a term begins. In case of verified downtime or a material service issue attributable to us, we may grant a service credit at our discretion.
  • If a subscription is purchased via a marketplace or app store, its refund rules apply.

6) Digital Deliverables & Licenses

  • Digital deliverables (source code, builds, designs, documentation) are non-returnable. If a material defect attributable to us is reported within the warranty/support window (see Terms), we will repair or re-deliver; refunds are considered only if repair is not commercially reasonable.
  • License fees are non-refundable once keys or access have been issued/activated.

7) Third-Party Fees & Pass-Throughs

Fees paid to third parties (cloud, SMS/voice, email, payment gateways, app stores, analytics, etc.) are non-refundable by us. You may pursue any remedy directly with the third party per their terms. Where we administered purchases on your behalf, we will assist on a best-effort basis to seek credits where available.

8) How to Request a Refund

  1. Email support@qbicorn.me with subject “Refund Request – Qbicron Technologies Pvt. Ltd.”.
  2. Include your company name, invoice/transaction ID, dates, and a brief rationale.
  3. Attach supporting evidence (SOW, approvals, screenshots, logs, etc.).

9) Assessment & Resolution Timelines

  • We typically acknowledge refund requests within 3 business days.
  • Investigation and outcome are usually completed within 10–15 business days, depending on complexity and third-party inputs.
  • If approved, the refund/credit is initiated promptly (see Section 10 on settlement).

10) Mode of Refund & Taxes

  • Refunds are processed via the original payment method where feasible; otherwise via bank transfer to the original payer.
  • GST/Taxes: Where legally required, we will issue a credit note and adjust taxes per Indian GST rules. Exchange fees or bank charges, if any, may be deducted from the refund amount.
  • Cross-border refunds are subject to applicable FX rates and intermediary fees.

11) Chargebacks & Disputes

If you initiate a chargeback without first contacting us to resolve a genuine billing concern, we may suspend services and contest the chargeback with documentation. This does not limit your rights under applicable law.

12) Compliance & Consumer Law

Nothing in this policy limits your statutory rights under applicable Indian laws. This policy is governed by the laws of India. Subject to any mandatory law, disputes will be handled as set out in our Terms of Service (including arbitration/jurisdiction—typically Bengaluru, Karnataka).

13) Changes to this Policy

We may update this Refund Policy from time to time. The “Last updated” date above reflects the current version. Material changes will be communicated through our website or email where appropriate.
